Strengthening liability for air pollution, destruction or damage to flora.
The Law “On Amendments to Certain Legislative Acts of Ukraine in order to preserve the environment with regard to strengthening responsibility for actions aimed at air pollution, destruction or damage to flora objects” was adopted. The law provides for improving the procedure for bringing to responsibility for air pollution, destruction or damage to flora, violation of the fire safety requirement in forests and unauthorized burning of dry vegetation or its remains in order to reduce the destructive consequences and protect the right of citizens to safe air and the environment, and also to reduce the number of fires that occur for this reason.
The law is amended:
– in Articles 241, 245 of the Criminal Code, which propose to increase the size of fines for air pollution (from 100 – 200 to 1800 – 3600 tax-free minimum incomes of citizens) and for the destruction or damage of flora objects (from 300-500 to 5400-9000 tax-free minimum incomes of citizens)
– in Articles 77, 77-1 of the Code of Ukraine on Administrative Violations, which significantly increase the size of fines for violation of the fire safety requirement in forests (from 5-50 to 90-900 tax-free minimum incomes of citizens), for unauthorized burning of vegetation or its remains ( from 10 – 70 to 180 – 1260 tax-free minimum incomes of citizens) and for unauthorized burning of vegetation or its remains within the territories and objects of the natural reserve fund (from 20 – 100 to 360 – 1800 tax-free minimum incomes of citizens).
The law also brings the provision of article 77-1 of the Code of Ukraine on administrative offenses in accordance with part three of article 27 of the Law of Ukraine “On the flora”, according to which the burning of dry vegetation or its remains is carried out in the manner established by the central executive body, which ensures formation of state policy in the field of environmental protection.
